Law Governing Property After Divorce (Non-Muslim)

For non-Muslims, the law govern the division of property after divorce is under:

Section 76 of the Law Reform (Marriage and Divorce) Act 1976

Under this provision, the Court has the discretion to divide property acquired during the marriage in a manner that is just and equitable.

What Property Can Be Divided After Divorce?

After a divorce, the Court may divide matrimonial assets, including:

  • Matrimonial home
  • Houses, apartments, land
  • Vehicles
  • Bank savings and fixed deposits
  • EPF and retirement savings
  • Businesses and investments
  • Insurance policies
  • Household items

Property does not need to be jointly owned to be divided.

Property Registered in One Spouse’s Name

A common misconception is that property belongs solely to the person whose name appears on the title.

In Malaysia, this is not true.

Even if one spouse registers the property in their name, the other spouse can still claim a share if they can prove:

  • Financial contribution (loan repayments, purchase price, renovations); or
  • Non-financial contribution (childcare, homemaking, supporting the family)

Is Property Divided Equally After Divorce?

There is no automatic 50:50 division.

  • Indirect contributions (home-making and caregiving)
  • Duration of the marriage
  • Welfare of the children
  • Each party’s earning capacity
  • Debts and liabilities

What Happens to the Matrimonial Home?

After a divorce, the Court may:

  • Order the sale of the property and division of proceeds
  • Transfer the property to one spouse with compensation to the other
  • Allow one spouse (often the caregiver) to continue occupying the home, especially where children are involved

Each case depends on its facts.

Property Acquired Before Marriage

Property acquired before the marriage is generally not divided.

However, it may be considered matrimonial property if:

  • Mortgage payments were made during the marriage;
  • The property was renovated using joint funds; or
  • The value increased due to joint efforts

If the parties cannot agree on how to divide the property, the Court will decide the matter during divorce proceedings or through a separate application for the division of matrimonial assets.
