How to Apply for Marriage Counselling (Marriage Tribunal) at JPN Malaysia (Non-Muslim)

In Malaysia, non-Muslim couples who wish to file for a divorce through a single petition is required to attend marriage counselling (also known as the Marriage Tribunal) conducted by the Jabatan Pendaftaran Negara (JPN).

What is the Marriage Tribunal in Malaysia?

The Marriage Tribunal is a compulsory counselling process provided under Section 106 of the Law Reform (Marriage and Divorce) Act 1976 (LRA 1976).

The purpose of the tribunal is:

  • To attempt reconciliation between spouses
  • Assess the marriage issues
  • To issue a Certificate of Non-Reconciliation if reconciliation fails

Without this certificate, a single petition divorce generally cannot proceed in court.

Is Marriage Tribunal Mandatory in All Divorce Cases?

No. Marriage tribunal is NOT required in all cases.

Marriage Tribunal is only REQUIRED when:

  • One spouse is filing for divorce alone (single petition)
  • The marriage is a non-Muslim civil marriage
  • No statutory exceptions apply

Marriage Tribunal is NOT required when:

  • Divorce is filed by joint petition (both parties agree)
  • One spouse cannot be located
  • There is proven domestic violence, abuse or exceptional hardship
  • The court grants an exemption under Section 106(2) LRA 1976

Who Conducts the Marriage Tribunal?

  • Officers appointed by JPN
  • Usually consisting of a panel of counsellors

Step-by-Step: How to Apply for Marriage Tribunal at JPN Malaysia

Step 1: Identify the Correct JPN Office

You must apply at the JPN office where your marriage was registered or the JPN office that has jurisdiction over your residence

Step 2: Prepare Required Documents

You will need:

  • Original and copy of Marriage Certificate
  • Original and copy of MyKad / Passport
  • Completed Marriage Tribunal Application Form (JPN.KC14)
  • Address and contact details of both spouses

Step 3: Submit Application at JPN Counter

Attend the JPN office in person to:

  • Submit your application
  • Receive a tribunal reference number

Step 4: Attend Marriage Counselling Sessions

  • Both spouses are required to attend
  • There may be multiple sessions
  • Counsellors will attempt reconciliation
  • Each party may be heard separately or together

Step 5: Outcome of the Marriage Tribunal in JPN

There are two possible outcomes:

Reconciliation Successful

  • Marriage continues
  • Divorce proceedings do not proceed

Reconciliation Fails (JPN.KC28 or JPN.KC29)

  • If one spouse failed to attend the marriage counselling sessions in JPN, JPN will issue a Certificate stating that the spouse failed to attend (JPN.KC28)
  • If reconciliation fails (after both parties attend), JPN issues a Certificate of Non-Reconciliation (JPN.KC29)
  • You may proceed to file a single petition divorce in court enclosing the JPN.KC28 or JPN.KC29

How Long Does the Marriage Tribunal Process Take?

On average:

  • 1 to 3 months, depending on:
    • Availability of tribunal panels
    • Cooperation of both spouses
    • Number of counselling sessions required

Delays may occur if one party repeatedly fails to attend.

  • Applying for tribunal when joint petition divorce is possible
  • Filing divorce papers without the certificate
  • Attending the wrong JPN office
  • Assuming tribunal guarantees divorce approval (it does not)
