Joint petition vs single petition divorce in Malaysia

Joint Petition or Single Petition?

A joint petition is filed by both spouses when they agree to divorce and on the terms, including custody, maintenance and property. It is usually the quicker and less costly route.

A single petition is filed by one spouse when the other does not agree. The petitioner must show that the marriage has broken down irretrievably, relying on facts such as adultery, behaviour that the petitioner cannot reasonably be expected to live with, desertion for at least two years, or separation for at least two years. Where Divorce Petitions From Petaling Jaya Are Filed

For couples living in Petaling Jaya, a divorce petition is generally filed at the High Court in Shah Alam. Couples living in Kuala Lumpur file at the Kuala Lumpur High Court. We prepare and file the petition and supporting documents, and attend court on your behalf.

Frequently Asked Questions on Divorce in Malaysia

Who can file for divorce under the Law Reform (Marriage and Divorce) Act 1976?

Non-Muslim couples whose marriage is registered or recognised in Malaysia, and who are domiciled or resident in Malaysia. Generally, a petition cannot be filed until two years after the date of marriage, unless the court grants leave in exceptional circumstances. Muslim divorces are dealt with by the Syariah Courts.

How long does a divorce take?

A joint petition typically takes around 3 to 4 months. A contested single petition can take a year or longer, depending on the issues in dispute and the court’s schedule. See how long a divorce takes in Malaysia.

How does the court divide matrimonial assets?

The court considers each spouse’s contributions, both financial and non-financial (such as caring for the home and children), any debts owed by either party for their joint benefit, and the needs of any minor children.

How does the court decide child custody?

The welfare of the child is the paramount consideration. The court looks at the child’s age and needs, each parent’s ability to care for the child, and the child’s wishes where the child is old enough to express them. There is a rebuttable presumption that it is good for a child under seven to be with the mother.

What if my spouse refuses to agree to the divorce?

You can still proceed by single petition, provided you can prove that the marriage has broken down irretrievably on one of the recognised facts.

How much does a divorce cost?

It depends mainly on whether the divorce is by joint or single petition and on how many issues are disputed. A joint petition costs considerably less than a contested divorce. Contact us for a fixed fee quotation for your matter.

What documents should I prepare?

Your marriage certificate, your identity card, your children’s birth certificates (if any), and details of matrimonial property, savings and debts.

Do I need a lawyer for divorce?

You may represent yourself, but a divorce involves court documents, procedure and decisions on custody, maintenance and property that are difficult to change later. See do you need a divorce lawyer in Malaysia.
